RockRooster

Terms of Service

Effective date: 28 October 2026 Last updated: 28 October 2026

These Terms of Service (“Terms”) govern your access to and use of www.rockrooster.com.au (the “Site”), operated by RockRooster Footwear (“RockRooster”, “we”, “us”, “our”). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

The Site is a business-to-business information and enquiry channel. It is not a retail store: there is no account registration, no shopping cart and no online checkout, and no order is concluded through the Site. Commercial terms of supply — minimum order quantity, pricing, payment, returns and shipping — are set out in our Wholesale Policy and in the written quotation we issue to you.

1. Who may use the Site

  • You must be at least 18 years of age and act in a business capacity (retailer, distributor, or their representative).
  • You must not misrepresent your identity, company, territory or authority when submitting an enquiry.
  • You are responsible for the accuracy of the information you provide to us and for keeping it current.

2. Permitted and prohibited use

Permitted: browsing product information, downloading catalogues, submitting wholesale enquiries, and contacting our team.

Prohibited:

  • Using the Site for any unlawful purpose, or in breach of any applicable export, sanctions, product-safety or consumer-protection law
  • Systematic scraping, harvesting, bulk downloading or mirroring of Site content, or any automated access that imposes an unreasonable load on our infrastructure
  • Reverse engineering, penetration testing or security scanning without our prior written consent
  • Using our trademarks, product photography or catalogue text to market competing products, or in any way implying endorsement or partnership
  • Removing, altering or obscuring copyright, trademark or other proprietary notices
  • Introducing malicious code, or interfering with the availability or integrity of the Site

We may restrict or block access where we reasonably believe these Terms have been breached.

3. Product information, specifications and certification

We work to keep product information accurate and current, but:

  • Specifications, materials, colour rendering, dimensions and availability may change without notice. Screen colour reproduction is approximate.
  • Stated standards and certifications (for example ASTM F2413) reflect the test report held for the model shown. They are not a warranty of fitness for any particular workplace, hazard, or jurisdiction.
  • You are responsible for verifying that a product meets the requirements of your market, including local personal protective equipment (PPE) regulation, labelling and documentation obligations. Current test reports and compliance documents are available on request before you order.

4. Quotations, prices and orders

  • Product pages, catalogues and price indications are invitations to treat, not contractual offers. A contract of sale is formed only when we issue a written order confirmation following credit, MOQ and compliance checks.
  • Quotations are valid for 30 days from issue unless stated otherwise, and are subject to the Incoterms, currency, taxes, duties and freight terms stated in the quotation.
  • Minimum order quantities apply as set out in the Wholesale Policy.
  • We may decline or limit an order on reasonable grounds, including creditworthiness, existing distribution rights in your territory, regulatory restrictions, or production capacity.

5. Intellectual property

All content on the Site — text, product photography, catalogues, graphics, logos, trade dress, layout, and the ROCKROOSTER name and marks — is owned by us or licensed to us, and is protected by copyright, trademark and other intellectual property laws.

You may view, download or print pages for your internal business evaluation only. You may not, without our prior written consent:

  • Reproduce, publish, distribute or communicate Site content to the public, including on marketplaces, social channels or your own website
  • Use our marks, product names or imagery as your own, or register any confusingly similar name, domain or mark
  • Create derivative works from our catalogues or product descriptions

Please do not send us confidential or proprietary information through the Site. Any feedback or suggestions you choose to submit may be used by us without obligation or compensation.

Product images and specifications supplied to authorised distributors for resale purposes are governed by the terms of the applicable distribution agreement, which take precedence over this section.

The Site links to, or loads content from, third parties including Google (Analytics, Fonts), YouTube, Meta (Facebook, WhatsApp) and messaging platforms. We do not control those services and are not responsible for their content, availability or practices. Your use of them is governed by their own terms and policies. See our Privacy Policy and Cookie Policy.

7. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy or non-infringement, and we do not warrant that the Site will be uninterrupted, error-free, secure or free of harmful components.

8. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot be limited under applicable mandatory law.

Subject to that, and to the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, goodwill, anticipated savings or data, however arising.
  • Our total aggregate liability arising out of or in connection with your use of the Site is limited to US$100.

This clause applies to your use of the Site only. It does not limit liability under a separate supply contract or distribution agreement between us.

9. Indemnity

You agree to indemnify and hold us harmless against claims, losses and reasonable costs arising from your unlawful use of the Site, your breach of these Terms, or your infringement of any third-party right.

10. Privacy and cookies

Our handling of personal information is described in the Privacy Policy; our use of cookies and similar technologies is described in the Cookie Policy.

11. Changes to the Site and to these Terms

We may modify the Site, or these Terms, at any time. The “Last updated” date at the top of this page reflects the current version. Material changes will be highlighted on the Site. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.

If any provision is held invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it.

12. Governing law and jurisdiction

These Terms, and any dispute arising out of or in connection with them or your use of the Site, are governed by the laws of the People’s Republic of China. The courts located in Hangzhou, Zhejiang Province, People’s Republic of China have exclusive jurisdiction, without prejudice to any mandatory rights you hold under the law of your country of residence.
